ADDENDUM TO JMSR POLICIES ON INTERNET SALES

JMSR AUTHORIZED RESELLER QUALITY CONTROL POLICY

I. PURPOSE

This Authorized Reseller Quality Control Policy shall apply to each reseller that is authorized by JMSR to order, carry, store and/or sell JMSR products, either domestically or internationally. The purpose of the Policy is to ensure the continued quality, efficacy, freshness, and authenticity of JMSR products across all channels. It shall be distributed to all authorized resellers and JMSR will take measures to ensure that authorized resellers continue to adhere to the Policy.

II. POLICY

It shall be the formal Policy of JMSR that all authorized resellers:

  1. Shall sell JMSR products only in their original packaging, unopened, with the sole exception of Professional products which may be applied to multiple clients by medical professionals or licensed estheticians;
  2. Shall store all JMSR products in a clean and dry environment;
  3. Shall store and use JMSR products at generally accepted room temperature (15°-25°C, 60°-77°F.) in an environment that does not otherwise subject the products to wide variations in ambient temperature;
  4. Shall not sell expired or discontinued JMSR products, but shall return all such product to JMSR or one of its authorized representatives;
  5. Shall ensure that the batch numbers and expiration dates on all JMSR products remain legible at all times and are not covered;
  6. Shall report all adverse events (including product reactions) to JMSR or an authorized representative of JMSR;
  7. Shall immediately report any serious adverse event (defined as an event involving medical intervention) to JMSR or an authorized representative of JMSR;
  8. Shall report to JMSR or an authorized representative any attempt by any person to collect expired, discontinued, excess, or unused JMSR product from the authorized reseller;
  9. Shall report to JMSR or an authorized representative any purported JMSR products noticed at another location or on another website that is believed to be from an unauthorized source, diverted, expired, discontinued, or counterfeit; and
  10. Shall be aware of and inform their customers of JMSR’s Limited Product Warranty and Return Policy and Customer Satisfaction and Return Policy, which can be found on our website (www.janmarini.com), and shall follow those Policies with all customers. JMSR will not guarantee the quality of JMSR products sold by unauthorized resellers, or by resellers who fail to adhere to this Policy.
